4. Manager’s Report
Captain Keith Davis, reporting for Chief Payne, said the police force has collected about $17,000 in overdue fines. He reported on two unusual burglaries in the city, one in which a federal i.d. was stolen from an unlocked car in a parking lot. The theft coincided with President Barack Obama’s visit to the Gulf Coast, and caused some alarm with federal officials. Thanks to the help of one of the City’s Parks and Recreation employees, the i.d. was recovered and returned.
Another burglary occurred in the home of a 83-year old woman whose grandson was involved in some criminal activity and his associates broke into the home hoping to recover some money.
Chief Gerald Smith reported on a fire last Friday at North Bay towing and informed the council that his crew will begin commercial inspections soon.
Parks and Recreation Director Mike Mullins reminded the council that girls’ all-star tournaments are being held this weekend at the Recreation Complex.
City Engineer Mark Seymour, Jr. reported that MDOT has been cleaning up the gutters of the D’Iberville streets that were recently re-paved. He said he will continue to pressure MDOT to complete a list of items that still need to be done on this project. Seymour also said that he and City Manager Michael Janus drove up to MDOT’s office asking them to give the City the go-ahead on the Sangani widening project. Seymour also sent them a letter asking for an update and MDOT has not responded as of yet. The City is waiting on final approval from MDOT before it can go forward with work on the Sangani area. Seymour added, “We keep pushing and pushing. Every week or two weeks that slips by…….it’s taking entirely too long.”
5. Citizens Comments (All comments are limited to 3 minutes per individual)
George Rogers, owner of the Hallmark Store in the Lakeview Shopping Center spoke to the council about his concerns about the possible affect the construction project will have on his and other’s businesses in the shopping center. He said that the current recession has been hard on his business and he relies on the 4th quarter/holiday season to make up his operating costs. He asked the council to plan for the needs of the businesses in the area and try to incorporate some kind of work stoppage or staggering of the project to avoid construction during the holiday shopping season, which he defined as being between October 1 through December 31.
The Mayor and Councilman Teddy Harder assured Mr. Rogers that his concerns were being considered and thanked him for attending the council meeting and voicing his concerns.
Mayor Quave made a motion to table agenda item #12. [APPROVED]
II. Acceptance of Agenda [APPROVED]
1. Presentation of the Mary Lou Buchanan Award
A representative of Triad told the audience that this award was named after Mary Lou Buchanan who was a D’Iberville citizen and dedicated volunteer and community activist. She belonged to a number of organizations and is honored annually by giving a volunteer award to the unsung heroes in the D’Iberville community. This year’s recipient is Johnny Mason. Mr. Mason worked with the D’Iberville Volunteer Foundation since 2005 when the recovery from Hurricane Katrina began. “Mr. Mason was the first smile to greet the volunteers and the last wave when they left.” He cleaned, repaired, did maintenance, carpentry work and a variety of other tasks. He volunteered hours of his time without asking for anything in return, except to make his community a better place.
2. Motion to approve awarding of bid on the D’Iberville Façade Grant Program – Bid Package #3 [APPROVED]
3. Motion to approve submittal of Justice Assistance Grant and to approve the City to pay matching portion [APPROVED]
Police Captain Walter Keck explained that this grant will allow the police department to purchase 5 new vehicles, eliminating the need to use some older vehicles that have become too expensive to maintain.
4. Motion to approve Resolution of the Council of the City of D’Iberville, Mississippi Approving Recurring Monthly Payments [APPROVED]
5. Motion to approve Alcohol Countermeasures (DUI Enforcement Task Force) Resolution [APPROVED]
Captain Keck explained that this grant will allow the police department to hire 2 DUI officers.
6. Motion to approve Occupant Protection (Enforcing Seat Belt and Child Restrain Laws) Resolution [APPROVED]
Captian Keck said that this is part of the Click-It or Ticket Program and pays for overtime.
Mayor Quave asked Captain Keck if the driver of a vehicle can be ticketed if the passenger in the vehicle is not wearing a seatbelt. Captain Keck replied, Yes, sir. The driver gets the ticket. Once you get into that vehicle, it’s your responsibility.”
7. Motion to approve Sharron Perkins and Jodi Weise to attend the Municipal Clerk Certification Program [APPROVED]
8. Motion to appoint a member to the Harrison County Motor Vehicle for Hire Commission [APPROVED]
Councilman Henry Toncrey nominated Mark Blackman to be D’Iberville’s representative on the commission.
9. Motion to approve Planning Commission Transcript of May 25, 2010 [APPROVED]
10. Case Number 2010-19-Kimberly Klein-Application for a Variance Request to allow exotic wild animals in a Pet Shop and Petting Park for the Leg’s, Fin’s and More business to be located at 10263 Gorenflo Rd. in a C-2 District (Denied by Planning Commission) [Motion to Deny: APPROVED]
Planning and Zoning Director Deonne Olier read a summary of the application by Bryant and Kimberly Klein to open an exotic animal pet store and petting park on Gorenflo Road. Olier told the council that eight citizens spoke in opposition, due to concerns over smell, escape of animals, noise, and possible contamination of water and soil. Olier said the opponents did not object to the pet shop, only to the outdoor petting park. Four people spoke in favor of the application and there was one letter of approval.
Councilman Stephen Furney asked if the applicants were present. They were not. Councilwoman Brenda Broussard asked if the people who were for the application were citizens of D’Iberville. Olier said that they were not.
11. Executive Session: Economic Development Issues

12. Motion to approve Seconded Amended and Restated Development and Reimbursement Agreement (Promenade) [TABLED]

Ray Werthner spoke about the value of the Jerry Lawrence Library and urged the council to think about its needs for expansion in the future.
