The mission of the Municipal Court Department is to provide an accessible legal forum, for individuals to have their court matters heard in a fair and efficient manner, while providing a high level of integrity, professionalism and customer service.

AMS IS NOT A SCAM
The City of D’Iberville has contracted with American Municipal Services (AMS) as their collection agency. In collaboration we work to collect unpaid fines and citations.
If you receive correspondence from them by mail or receive a phone call, please contact us to verify that you are on the collection agency’s list.
For questions regarding fines or citations please call the Clerk’s office at (228-392-7966).
PLEASE NOTE: You must go through AMS to pay your fines and/or citations and to obtain your balance.
DUI:
Upon conviction of a DUI (Driving Under the Influence) classes will be ordered for the defendant to complete. They are as follows:
Moving Violation Citations:
If a person under the age of 21 receives a first-time moving violation citation, they may ask the Judge if they could be ordered to take DDS (Defensive Driving School).
These programs are classes that can be taken online and upon proof of completion, the citation does not show on your driving record.
Any person over the age of 21 that received a moving violation citation and are wanting to take Adult DDS may ask the Judge if they qualify. The qualifications for Adult DDS are:

The court understands there are circumstances in which a person is unable to pay their fines; therefore, the City of D’Iberville offers Community Service for qualified individuals.
See below for their schedule.
Monday – Friday (some weekends).
7:00 a.m. to 4:00 p.m.
If you qualify for Community Service and are ordered by the Judge, you will receive paperwork from the Court outlining how many hours need to be worked along with the Rules and Regulations.
You will be provided with a copy of the paperwork from Court and will be directed to take it to our Public Works Department.
If you are set up for Community service and there is availability to work on the weekend, it serves as double time on your fines.
Should you have questions regarding what Community Service entails, we highly recommend you reach out to the Court with your questions.
Please note: You must appear before the Judge for Community Service to be ordered.

The following is important information on what to expect when coming to Court.
COURTROOM RULES
Dignity, Respect, and Decorum are essential to a Proper Courtroom Atmosphere.
The following requirements pertain to all parties entering the Courtroom.
Please be aware there is a security checkpoint in which any persons entering for court must go through.

Upon entry beyond the point of the metal detector signifies that a full understanding and acknowledgement of the above regulations for the security checkpoint.
For safety purposes, anyone over the age of 18 that has a pending charge against them will only be permitted to go into the courtroom. People who are under the age of 18 will be permitted to go into the courtroom with a parent or guardian.
On trial dates the only people permitted to enter the courtroom will be the defendants and anyone that has a subpoena. If you are wanting someone to testify in your case, you will need to contact the clerk’s office and have them subpoenaed. Do not bring your witnesses with you to court and expect them to be permitted into the courtroom. They will be allowed to wait in the lobby until called upon if and when they are needed.
If possible, please make arrangements for child care when you are scheduled for court.

You cannot reschedule a court appearance on the appearance date. You cannot call to reschedule your court date; you must come into the clerk’s office and sign for another court date. If you are set for trial, you must come in at least two weeks before the trial date to reschedule.
On court days, the courtroom doors will open at 12:30 p.m. and court will start at 1:00 p.m. Please be on time. There is not a set time limit on when court is in session and if you are late, you may miss your opportunity to see the Judge. This could result in a warrant being issued for your arrest for failure to appear.
If you are coming to court because of a no insurance violation, be sure to have a printed copy of your insurance with you. You will not be allowed to bring in your phone to show the insurance. If you have any evidence such as pictures and video, please have them printed out or downloaded onto a thumbdrive to present to the Judge. You will not be allowed to bring in your phone to show as evidence.
If you are not able to pay your fines in full, the Municipal Court Judge may allow you to get set up on a payment plan. You must come to court to be set up on the payment plan. Please note that anyone being set up on said payment plan will have the option to pay the fines in full within the first 30 days. If they cannot be paid in full at such time, there will be a one-time $50.00 court administrative fee added to the payment plan.
There are multiple instances where if a person is wanting to plead guilty and pay the fine in full; they will not have to attend court. If you would like to see if your charge(s) may fall under that category, please call the Clerk’s office and they will be happy to assist you.
To file a petition for a Domestic Abuse Protection Order occurring in the city limits OR if you reside within the city limits; you may do so with the City of D’Iberville Municipal Court.
Before filing a protection order; we strongly recommend you review the links below that will assist you through the process. Additional information is provided to determine if you qualify to file for a protection order.
Hearings on the protection orders are set within 10 days from the filing date.
Please be sure to include an address of the individual whom you are seeking protection from so they can be served in a timely manner.
The City of D’Iberville collaborates with the Gulf Coast Center for Nonviolence and provides a court advocate to be present for all court dates. Also, the court advocate is present during all hearings for protection orders held on a non-scheduled court date.
The Court recognizes when dealing with Domestic Violence, it can be a fearful time for the victim and we want to provide as much information as possible during this time period.
Procedure for filing:

If granted, an Ex-Parte Order is issued
Hearing is set and determination of Temporary Protection Order is issued.
If the Ex-Parte is not issued, a hearing will still take place.
When filling out the petition, the individual filing is considered petitioner and the individual whom the petition is against is considered the respondent.

The City of D’Iberville Municipal Court collaborates with The Modification Behavior Services, LLC.
They offer parenting classes and anger management classes. These classes, ordered by the court; are offered to adults, teens and couples who may need assistance.

To reinstate your driver’s license or check the status of your driver’s license you will contact the Mississippi Department of Motor Vehicles or go to the nearest DMV.
The form provided by the DMV is “My Clear Form”. This is completed by the DMV and will list all the citations and places where those citations occurred.
When you receive the form that shows the City of D’Iberville Municipal Court; bring that to the Court Department. The clerks will advise you on how to obtain the “Withdrawal of Suspension” form.
The Court does not charge for the Withdrawal of Suspension. When you receive the form from the court; take it back to the DMV and follow their direction on how to proceed.
Please note: the Court Department is not be able to provide information regarding the suspension of your license. We ask you refer to the steps above.
If you received correspondence from the DMV regarding a citation for no insurance and your license has been suspended; you will need to contact the DMV.
House Bill 325 states that part of the penalty for operating a motor vehicle without insurance includes a suspension of driving privilege for a period of one (1) year or until the owner of the motor vehicle shows proof of liability insurance that is in compliance with the liability limits required by Section 63-15-3(j).
This means you need to take proof of insurance to the DMV in order to keep your driver’s license from being suspended for a year. Withdrawal paperwork is not needed for this.
DO NOT bring proof of insurance to the Court. If you have already contacted the DMV and still need further assistance, please contact us.
